Terms of Service

These Terms of Service (“Terms”) govern the use of the iPhone and iPad app Pool Service Report (the “App”) provided by Moeki Kozawa (the “Developer”). By downloading, installing, or using the App, you (the “User”) are deemed to have agreed to these Terms.
1. Scope
These Terms apply to every use of the App by the User.
2. License grant
The Developer grants the User a non-transferable, non-exclusive right to use the App for personal or business purposes in accordance with these Terms. The User may not transfer, lend, or redistribute the App to any third party.
3. Prohibited conduct
The User must not engage in any of the following while using the App:
- Reverse-engineering, decompiling, disassembling, modifying, or creating derivative works of the App
- Removing or altering copyright or trademark notices in the App
- Removing or altering the “SAMPLE” watermark in exported PDFs by technical means without purchasing Pro
- Any conduct that violates law or public order and morals
- Any conduct that causes harm or damage to the Developer or any third party
4. User content
Content the User enters or creates in the App — customer sites, visit records, water-test readings, dosing entries, checklists, notes, photos, exported PDFs (“User Content”) — belongs to the User. The Developer claims no ownership of User Content. It is stored on the User’s device (and, if the User enables iCloud sync, in the User’s own iCloud account) and is not transmitted to the Developer’s servers (see the Privacy Policy).
The User is responsible for handling their own customers’ information (names, addresses, photos of their property, etc.) recorded in the App in accordance with applicable law and any agreement with those customers.
5. In-app purchase (Pro)
5.1 What Pro includes
The App offers a one-time-purchase Pro tier (“Pool Service Report Pro”). Buying Pro removes the full-page tiled “SAMPLE” watermark from exported service report PDFs (clean, client-ready output). The current feature comparison is listed on the Support page.
5.2 One-time purchase
Pro is a one-time purchase — there is no subscription. There are no automatic renewals or recurring charges.
5.3 Restoring purchases
On any device signed in with the same Apple ID, the User can restore Pro free of charge by tapping the “Restore purchase” button on the Pro screen.
5.4 Refunds
Purchases are processed by Apple, and refunds follow the App Store’s policy. To request a refund, contact Apple support. The Developer cannot process refunds individually.
5.5 Price changes
The Developer may change the Pro price as needed. Price changes apply only to future purchases and do not affect users who have already purchased Pro.
6. Intellectual property
All copyrights and other intellectual property rights in the App and in everything included with it (source code, design, text, images, trademarks, etc.) belong to the Developer or the respective rights holders. Rights to User Content belong to the User.
7. Data handling
How data handled in the App is treated is governed separately by the Privacy Policy.
8. Disclaimer
8.1 As-is
The App is provided “as is”. No warranty of any kind — express or implied — is made regarding fitness for a particular purpose, merchantability, accuracy, completeness, or uninterrupted operation.
8.2 Water chemistry values and dosing suggestions
All values the App computes or suggests — the LSI (Langelier Saturation Index), ideal-range indicators, and dosing suggestions — are reference estimates intended to assist pool-service work. They are calculated with commonly used industry formulas and assumed typical product concentrations, and they do not account for the actual condition of the pool, the specific chemical products in use, water volume inaccuracies, weather, bather load, or equipment condition.
The User is solely responsible for deciding what chemicals to add and in what amounts. Always read and follow the chemical product’s label directions and the manufacturer’s instructions, never mix chemicals, and re-test the water after dosing. The App does not guarantee the accuracy, completeness, or fitness of any computed value for any particular pool. The Developer accepts no liability for damage of any kind arising from the use of the App’s output, including damage to pool surfaces, equipment, or water quality, or harm to persons or animals.
8.3 Reports
Exported service report PDFs are generated from the values the User enters or approves. The User is responsible for the accuracy of reports delivered to their customers.
8.4 Data loss
Data is stored on the User’s device (and, where enabled, in the User’s own iCloud account), and may be lost due to device failure, loss, OS updates, or similar events. The Developer accepts no responsibility for damages resulting from data loss. We recommend backing up important data regularly using the App’s backup feature.
8.5 Limitation of liability
To the maximum extent permitted by applicable law, the Developer is not liable for any direct, indirect, incidental, or special damages arising from use or inability to use the App.
9. Service interruption and termination
The Developer may suspend or terminate the service, temporarily or permanently, without prior notice — for system maintenance, due to force majeure, or at the Developer’s discretion.
10. Changes to these Terms
The Developer may revise these Terms as needed. Significant changes will be announced on this page. Revised Terms take effect when they are posted here.
11. Governing law and jurisdiction
These Terms are construed under the laws of Japan. The Tokyo District Court is the exclusive court of first instance for any disputes related to the App or these Terms.
